Terms of Service
Effective November 2, 2026.
Trademark Screen is a free tool that screens a brand name against the USPTO federal trademark register and, if you ask, watches it for new filings. By using it, you agree to these terms.
1. A screen is not a clearance
The result is a first-pass screen, not a clearance opinion and not legal advice. It checks the USPTO federal register only. It does not search common-law use, state registers, social handles, or non-EU/non-UK registers, and the underlying data can lag live filings by days. A clear screen does not mean a name is safe to use or register. Get a trademark attorney for a full clearance before investing in a brand or filing an application (USPTO fee $350 per class — fees change, see the official schedule).
2. Free use and limits
The screen, domain check, EU/UK check, and watches are free. To keep the service usable for everyone, screens are limited to 10 a day per person. We may change the limits or the service at any time, and we may stop the service — if we do, watches and their alerts stop with it.
3. Watches and alerts
A watch checks the register once a week (Tuesdays, after the USPTO Gazette publishes) and emails you only if a new filing appears that is confusingly similar to your watched name at or above the alert level you chose. Checks are best-effort: the register can be slow or unavailable, data can lag, and we do not guarantee that every new filing will be found or that an email will arrive. Old marks on the register when you start watching never trigger an alert.
4. Your responsibilities
Use the service for lawful brand screening. Do not abuse it — no automated bulk screening, no attempts to bypass the daily limit, no use of the service to harass or mislead anyone. You are responsible for the names and email addresses you submit, and for checking that an email address you give is yours to use.
5. No warranty
The service is provided "as is" and "as available", without warranties of any kind. We do not warrant that screens are complete, current, or correct, or that the service will be uninterrupted or error-free.
6. Liability
To the extent permitted by law, we are not liable for any loss arising from your use of the service — including a missed filing, a wrong result, or a decision you made based on a screen. The service is free; the most we could ever owe you is the amount you paid us, which is zero. Nothing here limits liability that cannot be limited by law.
7. Changes
We may update these terms. The current version is always at this address, with its effective date at the top. Continued use after a change means you accept the new terms.
