About the data

Effective November 2, 2026.

Trademark Screen is a first-pass screen of a brand name against the USPTO federal trademark register. This page says, in plain English, where the data comes from, what it covers, and what its limits are.

Where it comes from

We query the USPTO Trademark Search public backend — the same backend the official search site at tmsearch.uspto.gov uses. It has no published API contract: it can change, slow down, or rate-limit us without notice. We do not have a special arrangement with the USPTO, and we are not affiliated with or endorsed by it.

How fresh it is

The register itself can lag live filings by days — a very recent application may not appear yet. The "Data as of" date on a result is the newest record date among the marks returned for your screen. If no marks are returned, there is no date to show. Before filing, check tmsearch.uspto.gov directly for the latest status.

What it covers — and what it does not

The screen checks the USPTO federal register only. It does not search common-law use, state trademark registers, domain names, social handles, or non-US registers. A clear screen does not mean a name is free to use or register. It is a screen, not a clearance opinion and not legal advice — get a trademark attorney for a full clearance before investing in a brand or filing an application.

What happens when the source fails

If the source does not answer or is rate-limiting us, the screen says so instead of showing a made-up result: you will see a clear message that the backend is temporarily unavailable and to try again later. A failed screen is never presented as a clear one.

The plan for bulk data

The officially sanctioned way to get this data in bulk is the USPTO's daily bulk files through its Open Data Portal. We plan to move the screen onto a local copy of those files before this becomes a paid product — a product you pay for should not depend on an undocumented backend. Until then the screen is free.
